Delaware Doula Services Mandate

Effective Jan. 1, 2026, the Delaware Doula Services Mandate (HB362) requires insurers to cover doula services for Delaware individual, small group, and large group fully insured policies issued on or after that date.

Key Provisions

  • Definition of Doula Services: “Doula services” are defined as services provided by a trained doula to offer physical, emotional, and educational support to pregnant and birthing individuals before, during, and after childbirth. “Doula services” include the following:
    • Support and assistance during labor and childbirth.
    • Prenatal and postpartum support and education.
    • Breastfeeding assistance and lactation support.
    • Parenting education.
    • Support for a birthing person following loss of pregnancy.
  • Mandated Coverage: Insurers must provide coverage for “doula services” when performed by a doula certified by the Delaware Certification Board. Services that includes all of the following:
    • At least three prenatal visits, each lasting up to 90 minutes.
    • At least three postpartum visits, each lasting up to 90 minutes.
    • Attendance through labor and birth.

Coverage must be provided for additional doula visits if recommended by practitioners or clinicians acting within their scope of practice.

Doula Certification/Registration

Highmark Delaware will require doulas to be certified or registered in the same manner required by the Delaware Division of Medicaid and Medical Assistance (“DMMA”) under § 530 of Title 31. Services Performed by a Doula Birth Worker, Per Diem

 

In addition, preventive medicine counseling codes 99401, 99402, and 99403 are eligible when submitted by a doula with DX Code Z391.
